Van Accessible Parking

Disability Van Accessible Parking allows room for people to load or unload a wheelchair, scooter, walker, or similar device used to transport a person who has limited or no use of their legs.

Enforcement of Act 799 went into effect January 1, 2019, to regulate Disability Van Accessible Parking penalties. Act 799 specifically defines that the vehicle authorized to park in the Van Accessible Parking space must be used to transport a person with limited or no use of their legs and uses a wheelchair, a three or four-wheeled scooter, a four-wheeled walker with a seat, or similar device.

Act 799 defines authorized parking use of a Van Accessible Parking space via a Van Accessible Parking decal. Law enforcement officers have clear authority to enforce the provisions of Act 799 on private and public property, such as at a mall, retailer, grocery store, private agency in the state, and other public venues.

What is Van Accessible Parking?

Parking spaces located on the shortest accessible route of travel to an accessible facility entrance of a building. Van-accessible parking allows room for people to unload a wheelchair, scooter, walker, or similar device used to transport a person who has limited or no use of their legs. Van-accessible parking locations have an extra three feet of width compared to regular accessible spaces.

Ignore the Sign and Pay a Fine

First Offense: A fine of no less than $250.00 and no more than $500.00.

Second and Subsequent Offenses: A fine of no less than $500.00 and no more than $1000.00.

Additional Costs: Towing, impoundment, and related fees as well as court costs.

Putting Parking Fines to Work!

Fifty percent of all fines collected are directed to the Governor’s Commission on People with Disabilities where 30% goes towards scholarship awards to persons with disabilities and 20% goes to public education on accessible parking. In 2023, the Governor’s Commission on People with Disabilities used these funds to provide 12 scholarships at $1000.00 each.
